I am taking the unusual step of inserting a reply here because this is a Pet Peeve of mine:
I sat one cycle as a member of the Nominating Committee, perhaps two or three years ago; and I was not happy with how it functioned.

I asked for the written criteria used in evaluating applicants; there was none!!

Then proceeded a totally AD-Hoc process with no real validity whatsoever.
--
Highly qualified applicants (IMHO), were eliminated because they did not agree with the Administration. This I found totally unacceptable.
--
The process is highly flawed and needs to be revamped or eliminated.

(1) A member of a corporation is entitled to inspect and copy, during regular business hours at the corporation's principal office, any of the records of the corporation described in s. 617.1601(5),
(2) A member of a corporation is entitled to inspect and copy, during regular business hours at a reasonable location specified by the corporation, any of the following records of the corporation if the member meets the requirements of subsection (3) and gives the corporation written notice of his or her demand at least 5 business days before the date on which he or she wishes to inspect and copy:
(a) Excerpts from minutes of any meeting of the board of directors, records of any action of a committee of the board of directors while acting in place of the board of directors on behalf of the corporation, minutes of any meeting of the members, and records of action taken by the members or board of directors without a meeting, to the extent not subject to inspection under subsection (1).
(b) Accounting records of the corporation.
(c) The record of members.
(d) Any other books and records.
(3) A member may inspect and copy the records described in subsection (2) only if:
(a) The member's demand is made in good faith and for a proper purpose;
(b) The member describes with reasonable particularity his or her purpose and the records he or she desires to inspect;
(c) The records are directly connected with the member's purpose.

Correction to Pres. Loewenstein's current column
Exploring the ability of every unit owner to vote for both UCO Officers and Executive
Board Members... Perhaps the actual reason for defeat of this motion, was an
oversight on G.L's part....
This particular issue was addressed on more than one occassion, in years gone by,
by previous chairs, certainly since I began attending Delegates' meetings, as an
interested seasonal resident in 2003,
Most fortunately, several villagers had complete recollection of this issue and were
able to convey the outcome to the assembled...It was further mentioned, that little
or no interest has come forward from the community at large, as evidenced in their
respective Boards or at Delegate Assemby meetings, where various associations, are
not represented, concluding that there was no need to re-visit this issue.
As a post script, had the current chair, and her committee met with their predecessors, ( in other words, done their homework )this would not have occured.

Investigation Procedures

Chapter 718 — A contract for purchase or transfer of a deed or lease (if rental) must be given to the Condominium Association. This must be accompanied by a $100 check made out to the Association for the investigation. The Association deposits this check and issues an Association check for $100 made out to UCO. A married couple will be one (1) investigation. A marriage certificate is needed if the names are different. All other requests will require separate investigations; therefore, checks will be required for each investigation. Anyone can bring the contract, etc., together with the check to UCO. An application will be given to the bearer of the contract and the check.

Chapter 718 — The completed original application must be returned to the Condominium Association. It should be examined immediately for completeness (proof of income, proof of age, if mortgaged — a commitment letter). Page #4 is to be notarized as the thirty (30) day time clock for approval or rejection starts when all necessary information is received at UCO.
A condo board member must sign page #4 of the application before it is returned to UCO for the investigation to begin. This will affirm that the Association has screened the application and is aware of it.
Anyone can bring the completed application, after being signed by a Board Member, to UCO, for the investigation process to begin.
Only a Condominium Officer or Board Member can pick up the completed investigation report. It is a confidential report and the Officer or Board Member will be made aware of the report's contents.

"The cable operators' refusal to provide the commission full information has delayed our investigation and inhibited our ability to examine allegations" stemming from nearly 600 complaints, he told the Senate Committee on Commerce, Science and Transportation.

The cable operators receiving fines were Comcast Corp., Time Warner Cable Inc., Cox Communications Inc., Charter Communications Inc., Cablevision Systems Corp., Bright House Networks, Harron Communications LP, Midcontinent Communications Inc. and Suddenlink Communications Inc.

POST OFFICE - SPECIAL LINE FOR CV, IS IT REAL
It has been announced at a number of venues, that due to the ambiguities surrounding the Mobile Postal Service Van; that a "Special CV Dedicated Line" has been opened at the Roebuck Road Post Office, at certain times of the business day.
It is not clear that this is true.

"SERVICE" REAL MEANING REVEALED

Legislators File Condo Owners Insurance Repeal Bill S 714/ H 419
1/20/09 Dear Florida Condo-Owners, Friends and Members,
The bill ( http://www.ccfj.net/PB09S714.html ) repealing the provision requiring condo owners to provide evidence of a currently effective policy of hazard and liability insurance has been filed. This was the provision in FS 718 that caused all the excitement:
FS 718.111(11)(g)2. The association shall require each owner to provide evidence of a currently effective policy of hazard and liability insurance upon request, but not more than once per year. Upon the failure of an owner to provide a certificate of insurance issued by an insurer approved to write such insurance in this state within 30 days after the date on which a written request is delivered, the association may purchase a policy of insurance on behalf of an owner. The cost of such a policy, together with reconstruction costs undertaken by the association but which are the responsibility of the unit owner, may be collected in the manner provided for the collection of assessments in s. 718.116.
The new bill -- H 419 + S 714 -- filed by Representative Ellyn Bogdanoff and Senator Dennis Jones will be effective July 1, 2009 -- if it passes the legislature. Thank you Representative Bogdanoff for keeping your promise!
Lines 155 - 165 will delete the provision that is causing such headaches!
Even if the statutes in the moment require such a policy, it's up to the association board to actually enforce this provision. The wording says: "the association may purchase a policy of insurance on behalf of an owner," meaning they can, but they don't have to.
So, how about using some common sense for about 6 month?

Hi all,
FS 718 does indeed provide strong sanctions in the case of delinquency of Fees. In essence they are:
1) Acceleration of all monies due to the end of the Budget year.(Filing of lien)
2) Charging Interest on amount due up to 18%
3) Administrative/Late fee up to greater of $25.00 or 5% of each delinquent installment.
4) Rejection of lease if Unit Owner is in arrears.
No mention of “Removal of Privileges” is contemplated in The Act, so don’t get “creative” Please read the extracts following:

(g) Assessments.--The manner of collecting from the unit owners their shares of the common expenses shall be stated in the bylaws. Nothing in this paragraph shall preclude the right of an association to accelerate assessments of an owner delinquent in payment of common expenses. Accelerated assessments shall be due and payable on the date the claim of lien is filed. Such accelerated assessments shall include the amounts due for the remainder of the budget year in which the claim of lien was filed.

(3) Assessments and installments on them which are not paid when due bear interest at the rate provided in the declaration, from the due date until paid. This rate may not exceed the rate allowed by law, and, if no rate is provided in the declaration, interest shall accrue at the rate of 18 percent per year. Also, if the declaration or bylaws so provide, the association may charge an administrative late fee in addition to such interest, in an amount not to exceed the greater of $25 or 5 percent of each installment of the assessment for each delinquent installment that the payment is late. Any payment received by an association shall be applied first to any interest accrued by the association, then to any administrative late fee, then to any costs and reasonable attorney's fees incurred in collection, and then to the delinquent assessment. The foregoing shall be applicable notwithstanding any restrictive endorsement, designation, or instruction placed on or accompanying a payment. A late fee shall not be subject to the provisions in chapter 687 or s. 718.303(3).
(4) If the association is authorized by the declaration or bylaws to approve or disapprove a proposed lease of a unit, the grounds for disapproval may include, but are not limited to, a unit owner being delinquent in the payment of an assessment at the time approval is sought

With the gate timed for two cars, the second right behind the first, the gate will remain constantly up so long as there is a steady flow of cars one right behind another. This is why. Picture two cars close to each other headed toward the gate. The first car slows down or stops until the gate goes up. The second car doesn’t have to pause, because it can go through on the first car’s triggering of the mechanism. As it passes through, though, the second car also triggers the mechanism, causing the gate to stay up, not only for its own passage but the next car's passage as well. The gate therefore stays up as long as the cars follow very closely on one another.
The problem comes when there is a gap between cars. Imagine a line of cars with a gap in the middle. Car 4 is in front of the gap. Now imagine an invisible car in the gap, which we will call Car 5. The invisible car is followed by the car in back of the gap. We will call it Car 6. When Car 4 goes through, the gate stays up for Car 5, the invisible car. But because Car 5 is invisible, it doesn’t trigger the mechanism to stay up for Car 6. Car 6 sees the gate remaining up for the invisible car and thinks it will remain up for it to pass through. But of course it does not.
Is this close to the right explanation? Has my invisible car only made the whole thing harder to understand?

TRAFFIC CONTROL IN CENTURY VILLAGE
There is some interesting discussion in the BLOG about speeding busses, Signage specification and the legality of Traffic Control in our Village.
I have done some research on these issues and as always, if there is intent to do something Legally and correctly it is straight forward.
As always There are specific steps to follow; following is a Template which can get us there.

In short it goes like this:

1) Place a Motion before the County Commission
2) Sign an agreement with the Sherriff (not an AD-HOC arrangement)
3) Re-do all Signage in CV to be legal
First we must drop all the nonsense about who owns what roads and the Private Property issues; the Law provides specifically for these issues and we can have Legal enforcement of traffic regulations on ALL roads in CV, not just on the Ring road; so please read the following and let your voices be heard:

Chapter 316 : State Uniform Traffic Control
FS 316.006 (Jurisdiction)

(a) Counties shall have original jurisdiction over all streets and highways located within their boundaries, except all state roads and those streets and highways specified in subsection (2), and may place and maintain such traffic control devices which conform to the manual and specifications of the Department of Transportation upon all streets and highways under their original jurisdiction as they shall deem necessary to indicate and to carry out the provisions of this chapter or to regulate, warn, or guide traffic.

(b) A county may exercise jurisdiction over any private road or roads, or over any limited access road or roads owned or controlled by a special district, located in the unincorporated area within its boundaries if the county and party or parties owning or controlling such road or roads provide, by written agreement approved by the governing body of the county, for county traffic control jurisdiction over the road or roads encompassed by such agreement. 1. Provision for reimbursement for actual costs of traffic control and enforcement and for liability insurance and indemnification by the party or parties, and such other terms as are mutually agreeable, may be included in such an agreement.

Prior to entering into an agreement which provides for enforcement of the traffic laws of the state over a private road or roads, or over any limited access road or roads owned or controlled by a special district, the governing body of the county shall consult with the sheriff. No such agreement shall take effect prior to October 1, the beginning of the county fiscal year, unless this requirement is waived in writing by the sheriff.

3. The exercise of jurisdiction provided for herein shall be in addition to jurisdictional authority presently exercised by counties under law, and nothing in this paragraph shall be construed to limit or remove any such jurisdictional authority.

4. Any such agreement may provide for the installation of multiparty stop signs by the parties controlling the roads covered by the agreement if a determination is made by such parties that the signage will enhance traffic safety. Multiparty stop signs must conform to the manual and specifications of the Department of Transportation; however, minimum traffic volumes may not be required for the installation of such signage. Enforcement for the signs shall be as provided in s. 316.123.

I. EXECUTIVE BRIEF
Motion and Title: Staff recommends motion to approve: An Agreement with Mizner's Preserve Homeowners Association Incorporated (Community) for traffic control jurisdiction to be performed by the Sheriff’s Office.
Summary: This Agreement authorizes the Palm Beach County Sheriffs Office to provide traffic control enforcement services within the above-referenced private residential community.
District: 5
Background and Justification: Section 316.006, Florida Statutes, provides that the County may exercise traffic control jurisdiction over private roads by written Agreement after consultation with the Palm Beach County Sheriff’s Office. The community wishes to contract with the County for performance of law enforcement services and functions relating to traffic control within its boundaries in Palm Beach County, Florida. The community desires to have the Sheriff and his deputies control traffic upon its roadways. This will be provided at the discretion of the Sheriff.

The Funny Papers

POINT OF INFORMATION TO CENTURY VILLAGE
The computer club members each pay approximately $100.00
per month to WPRF. Our club has over 500 members; therefore
what they pay is equal to $50,000 per month. Fifty Thousand
($50,000.00) per month equals $600,000.00 per year. The
computer club buys it's own equipment. No other club in Century
Village pays $600,000.00 a year and buys the equipment for it's
members to use for learning purposes. The Computer club
members, for the most part don't use the sailboats, the ping-pong
room, the ceramic or lapidary room, and the woodworking shop.
These rooms are not open for use.
Why should the computer club classroom to open to the non-
members and the public? The computer club classroom contains
very expensive equipment and some of the most expensive in
the clubhouse. The club members should have some say as to
how the classroom is used. The computer club rents the room
for $600,000.00 a year.

Tips on Driving and Shaving
The real reason for this BLOG is to find out if I can post a BLOG. I’ve had a problem doing so in my last few attempts.
Driving WHILE shaving is not recommended. The following are two driving tips and one shaving tip:
1. When driving by parked cars on the right side of the road, look UNDER the cars to see if you see the feet of someone, perhaps a child, walking in front of a parked car into your driving lane.
2. When driving in a potentially dangerous situation where you feel you might need to use your horn, if you can safely free one hand, keep it poised over the horn, so you can blow the horn immediately. A lot can happen in a fraction of a second, as we know from watching the Olympics. The extra fraction of time you gain could prevent an accident.
3. Do you men like it when the barber puts that warm lather on your skin? If shaving the “old fashioned” way with a razor and shaving cream, let the can of shaving cream soak in hot water for five minutes, and you’ll get the same effect. (Does everyone already know this?)

COMCAST HAS NO SHAME!
To this very day, I continue to receive calls from upset CV Unit Owners about the removal of channels from our Cable service. The most bitter complaints are in regard to the removal of the Catholic EWTN (Eternal Word Television Network).
It may not be generally know just how egregious and coercive this action was; because, in fact the EWTN costs Comcast nothing, as the channel is subsidized by donations:

2b. How is EWTN financed?
EWTN is donor-based. It is financed entirely by donations from its viewers, listeners, supporters, and benefactors. There are no shares, no invested funds, and EWTN receives no advertising or syndication income.
Mother Angelica founded the network relying on Divine Providence, and this mode of operation continues to this day.
2c. Does EWTN charge for its services?
EWTN does not charge for its services. All its satellite signals are "free to air", that is, available at no cost. It offers its programme transmissions free directly to the viewer, as well as to cable operators, broadcast television and radio stations.

long line of auto's in the Guest lane, some crossing over from the transponder lane..
Thinking they too, were unhappy with the "bump & hump, or is it Hump & Bump"?
as I crawled closer, it became obivious......The transponder lane, was shut down.....
someone, zoomed through, breaking the arm.......once more... Undoubtly, the occurances have been reduced, but NOT eliminated....certainly hope the fines have
now been substantially increased, and the excess ( after the repairs ) monies put
into a fund, to offset damages to private autos of residents, who in time, will begin
legal action... Other issues have provoked legal action, could this be far behind?
And We Thought Comcast Was Bad
