My name is Randall Borchardt. I am now, and have been the Chair of the Advisory Committee of UCO for at least 4 years. I have tried my darndest to remain neutral over the years in regards to which candidates I favor for vacant offices. My asserted neutrality will of course remain as such only because I believe that Delegates must make informed choices as to the selection of officers which lead us, and should not be influenced by any one person's opinion. If any such influence does exist, the source should ideally come from the constituents of each Delegate's own association. This being said, I am compelled to share with you all that a legal opinion from UCO's chief counsel, Rod Tennyson, has been obtained, and that Howard Silver's position of Vice President has been legally vacated.
The Special Meeting of the Delegate Assembly for the purpose of accepting nominations from the floor for vacant offices is drawing near (Friday, July 25th, 2008). I believe that I am fulfilling my fiduciary responsibility to Century Village to inform as many Delegates as possible, as early as possible, of this pending vacancy.
Many Delegates choose to run their association in a strictly democratic fashion by polling their constituents with regards to important decisions made by the Delegate Assembly of UCO. The choices of which candidates to fill which vacant offices are among the most important decisions. So as to permit the Delegates the window of opportunity to poll the unit owners of each association as to their choices for each of the vacant offices, I have taken it upon myself to announce that there is presently a vacancy in the office of President, and also two vacancies in the offices of Vice President. The candidate who receives the highest number of votes shall serve for the completion of the longest remaining term (approximately 20 months); The runner up shall complete the shorter term (approximately 8 months).
The following is the opinion received by Rod Tennyson:
For UCO Vice Presidents,
I have reviewed the FAX sent to my office which contained the following written message: From the Desk of Vice President Howard Silver
"It is time to go when 117 Delegates told me to shut up and gave me no respect as Vice President of UCO. I’m moving on to better things where people will appreciate my doings."
In my opinion the above written note constitutes a written resignation from VP Howard Silver under the UCO Bylaws and Section 617.0842 F.S. Therefore this VP Office is now vacant and can be filled by the Delegate Assembly.

Apparently the question that has plagued many of us since last Friday has finally been laid to rest: Has V.P. Howard Silver legally resigned or not? Apparently, as per UCO's legal counsel, he has legally done so. Let us all give thanks for the valuable service that Howie has given to the Village over the years, and now move forward.

You are demonstrating the quintessential example of “proper notice” that the Delegate Assembly clearly demonstrated was meant by the Sunshine Bylaw amendment. You have recognized that this information must IMMEDIATELY be delivered to the Delegates.
The Delegate Assembly has spoken, and will, I hope, continue to require they make all decisions henceforth. This was always the intent of a UCO for the governance of Century Village. Finally this Administration, now and future Administrations will be able to function under those very terms.
The power was returned to the ”people”.

The treasurer has adopted a wait and see attitude, until she sees the outcome on Friday. Remember she has only spoken of considering a resignation.
It has been said she has not come into the office to work on the books for one or two days, why? Unknown. just another example of failing her responsibility.
the tapes of the mtg show the truth, after 25 minutes of filibustering Howie had not allowed the meeting to begin. Everyone filters the facts thru their own reality.
Now is our chance! Let's use our heads and not our emotions! Let's stop fighting and start working!
In 2 1/2 years, your administration did not produce the one unit-one vote that was promised to the unit owners when you were seeking the presidency. That issue remains a vital issue if a democracy is to exist. At no time did you or any of your officers give an explanation to the delegates, which as you know by now, are the Board of Directors of UCO.Not only did your administration not restore the vote of the unit owners as promised, but your next best move was to have all meetings in the dark. The budget of UCO is around $5 million, and all of that money comes from 309 associations. Any right thinking person would know that the help, even though voluntary, has some responsibility to answer the owners.
Which brings me to volunteering:to perform a service of one's free will...to do charitable or helpful work without pay...is there anything in these definitions that gives permission to these volunteers to expect or demand something in return? Often time, ungratefulness goes with volunteering and that just the way it is. Personally, I do not want to be obligated to anyone for any service they provide . I am a believer in paying my way. and not being obligated to anyone. So what exaclty are you complaing about ? We need professional management.
I do not know how much truth there may be to some recent comments. But look at George, Phyllis, Howie, Anonymous. The politics, the malice, the mistreatment of each other, and mistreatment going back several administrations. Painful, sad, unproductive, no good for Century Village. I see why more voices are asking for UCO to just be a business entity with a manager like WPRF. Oversight is good but we do not need power crazed volunteers in charge of our $5M/yr.
Just got through viewing the last delegate meeting on channel 63. A great majority of elected people were so full of themselves... believing in their own importance. Most of them, regardless of how many years of service they claim to have given to UCO, negated their so-called good intentions that they hopefully had at one time, by behaving like short, idiotic dictators.
I must congratulate every delegate that was at that meeting for their energetic defense of open meetings and democracy.In the end, it proved that an informed people make the right decisions everytime.
David Israel, by starting this blog, you did a magnificent service for the people of Century Village. Let's hear it for openness, transparency and democracy.!
