UCO

One of our Unit owners informed the board that UCO told her it was ok for people to stay in her unit when she was not there. Our By laws clearly state that no one can use a unit unless the owner is there and 30 days is the maximum stay. Has anyone run into this situation ? Mike

Hi Mike, In my building we put it in our by laws that guests are not permitted to stay in a unit unless the owners are present. We haven't had any problems. I think it was a good decision.

Hi Chris, Our By-Laws state the same. We revised our By-Laws in Feb 2006 and it was one of the revisions. Mike

The Legal running of your Association is your business.

Associations' documents.

In the interest of being fair…. Let’s presume you call the IRS, asking a simple question.
If you made 5 calls, you might get 3-5 different answers.

Just because someone works as a volunteer at UCO, does not automatically mean they are empowered to answer all questions correctly.

You are responsible to READ your documents and try to remain inside the boundaries set by your documents, or conversely required to promote the change in them via an amendment. Unless you are willing to grant multiple privileges to many Owners, so you too may violate your documents rules.

As Harry Truman said “the buck, stop here”, right at the doorstep of the Association Board of Administration. All you risk by noncompliance is legal claims for “selective enforcement” by those that you offend by refusing “privileges”, when others have been permitted the same in the past.

Become knowledgeable by reading your Condo Documents, and Chapter 718. It will do wonders for your own self-esteem.

Ed I have read the code but I'm note a code scholar and I understand my By-Laws. My ? was not about that but about the unit owner saying UCO said she could have people staying in her unit when she was not there when our by-laws clearly state it is not permitted but thanks for your input anyway. Mike

Some times people who come to the UCO office do not "hear" what they are being told. They hear that some associations may allow guests when the owners are not there while other associations do not, "hear" only some associations and assume it is theirs.

I am amazed at some of the questions posed by residents that come to UCO.
Most of these people do not ask their own officers or ever read their documents.

You are correct, however as Larry has stated, some folk only hear what they want to hear to cause your Board to relent, perhaps?

Some Associations have adopted an amendment providing for “adult children” to visit in the owners’ absence.

This amendment may be in conflict with the class known as “family”. This class designation by Fair Housing implies that any adult family member may fit this presumption. While our Associations believe they may restrict to only adult children.

This may have been the reason for the statement that was made: some may allow adult children……….
…….so why not our Association?

Hi Mike,
I put some of it thru a translator, it is a BLOG dedicated to Wine lovers.

Nothing wrong with that, but it is predominantly in Spanish.

If there is an outcry from our Spanish speaking CV'rs, If Vinho re-posts, I guess I will leave it in.

Any opinions on this would be appreciated.

It raises an interesting thought; here in CV we are becomming progressively more Polyglot; should there perhaps be a Russian BLOG, a Spanish or French BLOG...ETC.....

Why not? Is ac Poll in order??
