There have been a few questions in this BLOG as to when George expressed a negative view of Open Meetings. In addition, at the Delegate Assembly meeting of July 11, 2008 George stated from the stage that he was in favor of open meetings, with prior approval of the Committee Chair person (not an open meeting at all).
One might ask exactly what was/is the mind set of President Loewenstein and most of the other UCO Officers on this issue. Fortunately, they provided a very strong indication of what they were thinking in a Flyer which they signed and had distributed to the Delegates.
Following is a copy of that document for all to view, you read it and decide what this crew thinks of Unit Owner rights in Century Village; it is signed by

To his credit Frank Cornish did not sign this travesty.

VOTE NO
Against the motion that all committee meetings should be subject to the Sunshine Law.
First, let's look at those pushing for the approval of this motion.
1 - An individual who, during his/her term as Vice President of UCO in the prior administration never felt the need to have open committee meetings. (S)he has lost two subsequent elections and his/her motivation now seems to be that if this motion is passed,. (s)he can try to control the workings of the committee.
2 - The Vice President who, in the current issue of the UCO Reporter, has strongly come out against all open meetings. Given an opportunity to remove the article prior to publication, (s)he elected not to. Now, (s)he has flip-flopped and joined the other side. (S)he might want to re-read his/her prior article dealing with the definition of malcontents.
Next, let's get to the substance of the motion. Several years ago, the Finance Committee held Power Point presentations of the proposed budgets so that every resident could be involved in the process, They were free to ask questions, suggest changes, etc. Next, the delegate assembly gets to look at the budget and vote on it. This process will continue.
If this motion were to pass, potentially 13,000 residents could attend a committee meeting, thereby creating mass confusion, and impede the workings of the committee. Further, and most important:
Your officers continuously meet to deal with the daily problems in running our Village. Under this motion, we would no longer be able to do this, since 5 officers constitute a quorum. This would create a chaotic situation. The officers also meet with providers and support agencies to get information which is passed on to the residents though reports at Executive meetings, Delegate meeting and yes, even through many Town meetings for which our administration has been responsible.
The result of the passage of this motion would result in an ungovernable and non-functioning administration of Century Village. The question to be asked is if that is the ultimate goal of those forces pushing for this motion. Our administration prides itself on its openness, availability and constant transmission of information to our residents.
You can always volunteer to serve on a committee or call a chairman if you have an issue that you wish to discuss with the committee. You always have the right to review the minutes of all committee meetings.
Just four months ago, you elected this administration, giving us an overwhelming vote of confidence. If you still feel that we are living up to your expectations, we urge you to vote against this motion.

Resignations:
While the President of UCO (G. Loewenstein) turned in a written resignation, Mr. Silver has not!
Why hasn’t he completed the written statement that should accompany his verbal declaration of his resignation from both Vice-president and from Channel 63? He turned the controls of Channel 63 over to Mr. Kall. The officers committee needs clear direction so they may secure the building and bank accounts of UCO.
Our former President made a conscience effort to “be prepared” for the vote to not support his view and accordingly carried his written statement into the meeting, fully prepared to deliver this to the Treasurer.
That constitutes a premeditated act, allowing for clear thinking to evaluate this was an irrevocable act.
The Vice-president has now had more than sufficient time to prepare his statement and should complete same immediately.
To anonymous 3:22- Howie Silver did not turn over channel 63 to me. What he did do is hand me the containers for the channel 63 camera at the delegate meeting and told me he had resigned. I then secured the equipment say to it that it was put in a secure place by our property manage Pat Blunck.
I advised the officers about the situation. Because of my position as cable chair and since the community channel is provided by Comcast at no charge to us, I have been somewhat involved at times with the operation.Knowing what I know about how things work I stated that it may take a while before any updates can be made to the present information. I also know something about the equipment that was sent back to the factory and what the problem was.
I cannot speak about whether Howie will turn in a formal statement, that it up to him. I can only tell you what he told me and what I observed when he cam to the UCO office Friday afternoon to turn in his keys. I am confident that the remaining UCO officers will take all the necessary steps needed.
Please excuse the typos in my last statement as I am on my way out and wanted to get this on the blog as soon as possible.
Howie, Howie you just joined the club of people treated really badly by George Lowenstein. Hope you get over your mad and direct your anger where it should go. See where excessive loyalty got you.
I just read the Vote No flyer that was signed by George Loewenstein, Howard Silver, Sal Bummolo and Dorthy Tetro. It is my understanding that Loewenstein and Silver resigned because they were overruled by their Board of Directors..the Delegates.Good Bye !
Is anyone starting a recall on Bummolo and Tetro ? Having these people make a decision on who should be the next UCO president is asinine and idiotic.

Ok! remember, the appointment by the Officers Committee must be ratified by the Delegate Assembly at the next scheduled meeting.
Failing this ratification, a full up Election must be held.

Please remember the officers committee is not just Sal Bummalo and Dorothy Tetro there is also Frank Cornish, Betty Lapadis and Avis Blank. The UCO by laws does not address how a special election is to be held. Would there be a nomination committee? Would nominations come only from the floor? Who would conduct the election? There appears to be some unknowns in this matter. The best course at this time may be to let the officers committee pick the replacements which will only serve for about 8 months and then have a new election.

ARTICLE VI
C. Any vacancy of an elected office occurring before the expiration of a term shall be filled by the President on an emergency basis. In the event that the vacancy is in the Office of President, such vacancy shall be filled by a majority of the remaining Officers’ Committee Members. The filling of any vacancy in office must be approved at the next meeting of the Delegate Assembly at which a quorum is present. In the alternative, an election by the Delegate Assembly shall be held to fill the vacancy. Such officer shall serve for the un-expired term of the seat being filled.
My interpretation of this Bylaw provision is as follows:
A meeting of the Officers' Committee is called. (I believe it has been scheduled for this coming Wednesday).
The new President is appointed.
Once appointed, the President fills the vacancies.
Each appointment must be ratified at the next Delegate Assembly meeting. Should any or all appointments fail to be ratified, an election must be held for those positions which remain unfilled. The appointee(s) who are not approved by the Delegates immediately vacate their office.
If the appointment of the President fails to be ratified by the Assembly, the Officers' Committee should determine which Vice President should assume the presidency until an election can be held.
In any event, a legal opinion should be sought as to how to properly proceed if an election becomes necessary.

Are you trying to extend the insanity and illegality of UCO for 8 more months ?
The only one on the so-called officers committee that has earned the right to suggest or appoint anyone at all is Frank Cornish.
People like you have terrorized and taken advantage of the unit owners in this village for years; and you did it in the "name of the law". People WITHIN UCO; it is high time you come forward and stand up to all of this low-life behavior. Help those that have the courage to stand up. Clean up this UCO MESS. Or go to your cave and try getting a life.
Looking forward to a time in this village when people don't have to post under anonymous because they've been made aware that they are living in a gulag. King George wasn't smart enough to create this situation. He was one of many.
