ACCESS TO UCO RECORDS

Good luck getting a policy out of UCO The last time I asked I was almost thrown out of the UCO office. By the way, STATE LAW REQUIRES an association to have an insurance policy as part of it's documents.SEE STATE LAW 718.111 (12) Official Records..8. All current insurance policies of the association....

Now, keeping in mind that UCO is manned by Volunteers that work very hard, it is unreasonable to expect, as a routine procedure, that anyone can walk in and demand copies of anything immediately.

UCO is organized under Florida Statutes: FS 617, which provides a procedure for obtaining access to records.

617.1602 Inspection of records by members.

(1) A member of a corporation is entitled to inspect and copy, during regular business hours at the corporation's principal office, any of the records of the corporation described in s. 617.1601(5),


if the member gives the corporation written notice of his or her demand at least 5 business days before the date on which he or she wishes to inspect and copy.

(2) A member of a corporation is entitled to inspect and copy, during regular business hours at a reasonable location specified by the corporation, any of the following records of the corporation if the member meets the requirements of subsection (3) and gives the corporation written notice of his or her demand at least 5 business days before the date on which he or she wishes to inspect and copy:

(a) Excerpts from minutes of any meeting of the board of directors, records of any action of a committee of the board of directors while acting in place of the board of directors on behalf of the corporation, minutes of any meeting of the members, and records of action taken by the members or board of directors without a meeting, to the extent not subject to inspection under subsection (1).

(b) Accounting records of the corporation.

(c) The record of members.

--
(d) Any other books and records.

(3) A member may inspect and copy the records described in subsection (2) only if:

(a) The member's demand is made in good faith and for a proper purpose;

(b) The member describes with reasonable particularity his or her purpose and the records he or she desires to inspect;

--
(c) The records are directly connected with the member's purpose.


ETC......!
So! this provides a clear process if all else fails.
HOWEVER!!!

I suggest that you first find out if the President of your Umbrella Association has the Insurance policies, if not call Dan Gladstone (712-1923) and request them.
If this fails, write your letter, and in due course you will be served.

We pay our premiums to Plastridge Agency. Insurance agencies provide policies to their clients. State Law does not say UCO has to have a policy in it's records, it says that the association has to have a policy in it's records. Insurance Polices are renewed on a yearly basis. Any agreement between the association and UCO does not have a perpetual shelf life.

And what does volunteerism have to do with anything??

The umbrella organization is AN invention of UCO AND HAS NO LEGAL AUTHORITY.


THE ASSOCIATION'S INSURANCE POLICY IS NOT A UCO RECORD.


You pride yourself on not posting mis-leading information. This is TOTALLY mis-leading.

Misleading as you may find the references and the suggestion, UCO has the records that are sought.

We get the policies here in Greenbrier upon request thru the UCO Insurance Committee Chair.

You are of course free to acquire your Association Policies via any route you choose; please advise us all of any alternate approach that you find workable..

You must be kidding.You couldn't possibly be serious.Have Plastridge mail it to each association.That what all other insurance agents do.
