January 22, 2008Mr. Dear Mr. McNelis:Thank you for contacting my office regarding, H.R. 4088, the "Secure America through Verification and Enforcement Act" (SAVE Act). I appreciate your views on this important issue. The SAVE Act is an enforcement-only approach to address illegal immigration. I have very serious concerns with this legislation. First, the bill would require employers to use an internet-based system -- the E-Verify system -- which provides employers with an electronic means of verifying the employment eligibility of a recently hired individual. However, the E-Verify system is flawed and contains many serious problems. These flaws could force workers with erroneous information to be laid-off and would prevent them from working for any lawful business for the weeks or months it would take for government agencies to resolve the problem. Lawful employees should not have to fight the government just to keep working. Moreover, businesses should not lose experienced employees while government data glitches are resolved.In addition, the SAVE Act will expand detention facilities used to house illegal immigrants and would increase funding to local law enforcement authorities for enforcing our Nation’s immigration laws. However, enforcing our immigration laws is the responsibility of federal law enforcement officials, not local law enforcement officials. Enforcement-only policies will not repair our Nation’s broken immigration system. The punitive and enforcement-only focus of the SAVE Act will only force illegal immigrants into hiding and increase human trafficking. I firmly believe that this is an unacceptable result. Instead, we need a comprehensive approach that will repair the process used by immigrants to legally enter the country and become legal citizens; we need to repair the process for immigrants to legally work in our country; and we need to address the massive backlog of visas for immigrant families. This bill was only recently introduced in the U.S. House of Representatives. Please be assured that I will keep your views in mind as this bill is considered and debated on the floor of the House.
