WHO IS IN CHARGE - THE BYLAWS BE DAMNED

Hi all,
Well, I guess the Honeymoon is over! As the President of UCO left the Office he announced to me and another VP that during his absence for Passover, that Treasurer, Dorothy Tetro, would be "In Charge" of UCO.

Let's look at the relevant portions of the UCO Bylaws as regards duties of the various Officers:

A. PRESIDENT — The President shall be Chief Executive Officer of UCO and shall preside at all meetings of the Delegate Assembly and the Executive Board, except that he may designate a Vice President to preside at such meetings as he may deem necessary.

B. VICE PRESIDENTS — The Vice Presidents shall have such powers and shall perform such duties as may be recommended by the President and approved by the Executive Board, including, from time to time, the
designation of one of them to have all the powers and perform all the duties of the President during his absence.

C. TREASURER — The Treasurer shall keep a full and correct account of all cash receipts and disbursements and deposit all funds in banks, or financial institutions, in the name of and to the credit of the organization.

So, the conclusion is simple; the appointment of Ms. Tetro to "take charge" is a direct violation of the Bylaws of UCO, and is not to be recognized. I am advised, that this is not the first time that the current UCO President has appointed the Treasurer to preside in his absence. It was illegal then, it is illegal now!

The second VP I mentioned above advised the President of the violation of the Bylaws inherent in the appointment; this admonishment appeared to carry no weight.

George Lowenstein has got to go. He has been a TERRIBLE UCO President. The idiot Association Presidents who still support him need to be fired by their Associations!

Perhaps Mr. Lowenstein, is unaware
of the chain of command.....
He cannot appoint the Secretary, or
Treasurer, in his absence...It's
the Senior VP who assumes the responsibility..How much longer will he continue to RULE...He should be IMPEACHED! HOW ABOUT IT,
CALL FOR A SPECIAL 48HRS MEETING
TO ONCE AND FOR ALL STOP THIS CONTINUED DISREGARD OF ORDER....

Yes, not the 1st time and we MUST stop him NOW. We have capable VP's to take his place, why in the world would he choose to have Ms. Tetro take his place when she is busy enough trying to get he r own work done. A Vice President is the only one who should be appointed. Doesw Mr. Lowenstein think so little of his own Vice Presidents???????

Let's get rid of King George while he is in Israel. Call a special Delegates meeting and get rid of "His Arrogance" once and for all.

While we are getting rid of "His Arrogance "(Georgie Boy) , why not get rid of "Miss Incompetence" (Tetro) at the same time?

Was George not made aware of his mistake in naming the treasurer to take his place? As condo association officers we all had to sign papers saying we understood our positions. Does that apply to UCO? If George is not following UCO by laws to a 'T' then I am sure that are legal ways to correct that. I am all for haveing George out. I do not trust him at all to decide, with his committee, what to do with money coming to us from Comcast.

Dave, can't the UCO VPs just temporarily move Dorothy aside while George is away? You guys seem to have more power in that situation according to the UCO bylaws. Just tell Dorothy to stay at home until George comes back, then everyone (and their lawyers) can hash it out then.

Let us cover some interesting facts.
1. An effective impeachment of the President requires, in addition to the assembly of a Board of Inquiry,
the affirmative vote of 175 Delegates. It would be most unlikely to be able to assemble 175delegates and therefore, nearly impossible to achieve this required vote (a majority of the total voting members - 349) as per Chapter 617 F.S.
2. A special meeting may be called (by the President or by 35Delegates in writing)after a Board of Inquiry is chosen, convened, and a recommendation on the impeachment issue determined.
3. There is no senior Vice President. May I suggest that on an annual basis, the Delegates vote by secret ballot to establish a pecking order... 1st, 2nd, 3rd, and 4th V.P.

Please be advised that as of 10:30 a.m.this morning, our President has reconsidered his decision and has appointed Vice President Jerry Karpf as his temporary replacement.

Jerry Karpf knows who to call when your roof leaks. Jerry Karpf knows who to call when your elevator doesn't work. He has a terrific Maintenance Meeting, getting various experts together to give a talk. Many people like this, especially the people that give these talks. They pick up many customers without paying an advertising fee. Jerry Karpf is a nice person. I guess running a Maintenance Meeting is enough knowledge to take over the President of UCO's seat.
