A Note of Thanks.

I'd like to take this opportunity to thank the 98 delegates who voted for me....
we were unsuccessful this time, but I shall not fade into the sunset...
As a result of being a candidate, I have met many residents, who are experiencing
horiffic problems within their buildings, from no one at the helm, to those that
have a "Dictator" running the show...The time for change is now...If anyone out
there, reading this is currently Uninvolved, please become Involved....It's your
HOME, whether it be year round, or seasonal..you can make a difference!
Yes, you may have to rearrange your schedule somewhat, but the end result,is worth
the sacrifice..
Looking ahead to next year's election, do not be discouraged by the antics of this
year's "Election Board" a farce in its self. Hopefully, the likes of which will
be modified or eliminated altogether and make it a 'DEMOCRATIC' PROCESS, open to
ALL!
I am DELIGHTED in Knowing that Frank Cornish, now has the SUPPORT OF TWO OTHER
INDEPENDANT VP'S, namely David Israel & Bob Marshall...and the return of

ELECTION OF UCO OFFICERS

Hi All,
Just prior to the next Delegate Assembly (DA) meeting, at 8:00 am, there will be an election for the Executive Board and for two Vice Presidents of UCO.

There are three candidates for the two VP positions, they are: Ms. Claudette LaBonte, Bob Marshall and Yours Truly, Dave Israel.

I am advised that Ms. LaBonte was endorsed by UCO VP Jerry Karpf at a meeting of his Maintenance Committee. I am also advised that Ms LaBonte spoke at a meeting of the OWLS; is she an OWL member?

Ok; if UCO is supporting Ms LaBonte, so be it. This fact tells the voters that if you like the way UCO has functioned over the last 3 years; then she is your candidate.

I am distinctly not pleased with UCO Operations and I will stand to say so.

This is my only outlet for making my case and I earnestly request that you consider all of the facts and then support Bob Marshall and I for VP of UCO.

Now that the election is over and things appear to be calming down, I wish to thank you first for the creation of this blog that has allowed everyone to express the good, the bad and the ugly, but most of all I would like to thank you for your decision to run for president of UCO. As far as I am concerned, it was a chance for this village to go in the direction of legal, mutual respect and harmony----an opportunity for it to truly be a great place to live. You gave hope to many people . By your posting in the election cycle, people became better informed than ever before. That in itself is a great achievement; it never would have happened had you not announced your candidacy. The time for peace and harmony through legality is yet to come. Those of us who value respect and legalities will have to struggle a little longer.

It's dejavu all over again

In early spring of 1945, I was 10 1/2 years old and the atmosphere in the little village was thick with uncertainty and fear. We knew change was coming, but we were not sure if it was for the better. And change did come...in the form of the Soviet army. The Nazi's had all fled in a western direction, and the population of my small village was free to breathe, speak and hope. And so it shall be in this village. This time it will be David Israel that is going to give this village the oxygen to breathe, speak of freedom and legalities, and hope for a peaceful harmonious surrounding.

Evil cannot survive where good people dwell.

Special Meeting of the Delegate Assembly

Please be advised that UCO has been presented with a petition today with 77 Delegate signatures requesting that a Special Meeting of the Delegate Assembly be held on Friday, July 25th, at 9:30 A.M. in the Auditorium.

Only 35 Delegate signatures were required in order to make this meeting official.

The petition will be certified once at least 35 of the Delegate signatures have been properly verified. The purpose of this meeting is to take nominations from the floor for the vacant offices.

An election will be scheduled and officially noticed for 8:00 to 9:00 A.M. on August 1st, being held just prior to the regularly scheduled Delegates Meeting. I, and others will keep you posted.

Campaign Propaganda

Some of you may have recently encountered some propaganda affixed to your
private bulletin boards. My opponent is patting his back with a list of what he considers his "accomplishments."

I'm very impressed but not by what is listed but rather by what is missing from this document.
What about his involvement in telling the unit owners that they should send their monthly WPRF payments to the County Register and then to the Federal Court, where it was remanded to the unit owners who were then responsible for sending the same money to WPRF.

What about the lawsuit brought by WPRF against George, as a result of his actions?
What about his paying to have this suit moved to the Federal court?
What about the Judge sending it back to State Court for lack of cause? The Judge said that the reason for the movement had not been proven and even if it had been it was not cause for the movement. Have you ever heard of a Lawyer making such a grievous mistake that their law firm would pay the oppositions legal costs? The Judge had determined that these costs would be paid by UCO to WPRF. I believe these costs were between $4 and $5 thousand dollars!

What about this team calling Mr. Levy a thief and a liar? With this stoke of genius they eliminated any chance of his being able to negotiate a reasonable
settlement of what now is the Arbitration case.

In my opinion this was no accident. If this negotiation ended, as most successful negotiations do, with neither party totally happy, one because he did not get enough and the other because he gave too much then George would be the looser as he would have done the negotiation and the unit owners might have pointed the finger at him!
Now, however now if the settlement is less
than desired he can point to the court system and blame it! Is this the definition of leadership? Not in my dictionary!
Now, about the Arbitration case! Depositions are now being heard at the
tune of about $300 per hour for those called by UCO. There is also a court reporter involved. Are you aware the WPRF has again as a part of the Arbitration put the offer of a bit more than $1.8 million dollars on the table?

Are you aware that it is rumored that the CH2M HILL Engineering report
states that the amount owed is about$1.6 million? Why hasn't this report
been made available to interested unit owners?

Are you aware that if the Arbiters agree and award anything less than the offered amount plus 25% the looser, yes, that is the unit owners of Century Village WPB, could be assessed to pay all of WPRF's legal costs pertaining to this mess? WOW, is that an eye opener or what?

Vote Friday for an open Administration! Vote for Change!

Channel 63

By Bob Marshall:

A very good question has been asked on this blog concerning channel 63. I believe the current Channel 63 has shortcomings. I envision considerable changes. The simple answer is "like night differs from day!"

The current format of Channel 63 is in essence a rolling, scrolling, slideshow; while useful to a point, the format is boring. When actual events are taped and replayed later, the Home consumer camera produces an image, which is, to put it bluntly, amateur. Furthermore, because the sound track is not tied into the Microphone PA system, the sound is poor and not synchronized with the Video event. The original plan called for a Professional Studio Grade cameras; that plan was abandoned by the current administration for a cheap and non-perforating alternative.

Additionally, the original plan for Channel 63, called for surveying the Village to find retired TV professionals from careers behind and in front of the TV camera to present actual programming involving: Performance, News, Live coverage of Committee meetings, Interviews…Etc. In other words, Real TV Programming.

In addition to all of this, our Channel 63 should be run under the Federal guidelines of a Community Information TV Channel which, among other things, requires giving persons with views non-consistent with the establishment, equal time to air such views.

Under my administration Channel 63 would be a Communications vector for the people rather than the Loewenstein & Co usage as a Propaganda organ of selective information shaping.

All UCO meetings will be listed in a clear, easy to read format that includes, date, time and location. Additionally, a group, much like the Editorial Board of the UCO REPORTER, will be appointed to govern the input and operation of Channel 63 much like the Editorial Board functioned under my previous administration.

Please add your recommendations or comments, willingness to volunteer, all will surely be welcomed.

FOLLOWING ARE THE KEY “ACCOMPLISHMENTS” OF THE CURRENT LOEWENSTEIN ADMINISTRATION:

1) VICE PRESIDENT MYRON SOLOMON DRAGGED THE VILLAGE INTO A MAJOR LEGAL QUAGMIRE BY LAUNCHING A LAW SUIT IN VIOLATION OF THE MILLENIUM AGREEMENT PRIOR TO REQUIRED NEGOTIATION AND ARBITRATION; THIS POORLY CONCEIVED ACTION WAS VIGOROUSLY SUPPORTED BY PRESIDENT LOEWENSTEIN AND THE UCO OFFICERS TEAM; SHOULD THEY BE RE-ELECTED?

2) VICE PRESIDENT HOWIE SILVER, BASED ON WORK ACCOMPLISHED BY THE PREVIOUS MARSHALL ADMINISTRATION, PUT A DEGRADED VERSION OF CHANNEL 63 ON THE AIR WHICH EXHIBITS 1940’s LEVEL TECHNOLOGY IN LIEU OF A MARSHALL PLANNED PROFESSIONAL TV FORMAT; SHOULD HOWIE BE RE-ELECTED?

3) CURRENTLY WE ARE IN ARBITRATION, OUR CASE IS DUBIOUS AT BEST! WE ARE PAYING OUR LEGAL FEES WITH MONEY TAKEN FROM OTHER, BUDGETED, CRITICAL INFRASTRUCTURE LINE ITEMS, THIS IS THE “PLAN” OF THE CURRENT ADMINISTRATION, AN INTERESTING PROBLEM COMES OUT OF DEPLETING ESTABLISHED BUDGET LINES FOR THESE LEGAL COSTS; SHOULD WE IN FACT RECEIVE ANY AWARD FROM THE ARBITRATION PROCESS, IT WOULD BE PAID TO THE RESIDENTS, NOT TO UCO, HENCE RESTORING THE BUDGET INTEGRITY WOULD BE GREATLY DELAYED; SHOULD THEY BE RE-ELECTED?

4) THE LOEWENSTEIN TEAM HAS FAILED TO BUDGET FOR LEGAL EXPENSES WHICH HAVE NO FORESEEABLE LIMIT; SHOULD THEY BE RE-ELECTED?

5) THE LOEWENSTEIN TEAM HAS FAILED TO DISCLOSE, OR TO PROPERLY BUDGET FOR, THE COSTS OF SHORELINE RESTORATION OF OUR LAKES AND CANALS, WHICH WILL COST, IF DONE PROPERLY, BETWEEN 3 MILLION AND 8 MILLION DOLLARS; SHOULD THEY BE RE-ELECTED?

6) THE LOEWENSTEIN TEAM HAS FAILED TO BUDGET FOR A POTENTIAL INSURANCE DEDUCTIBLE OF $2,400,000.00 A LIABILITY OF $305.00 PER UNIT; SHOULD THEY BE RE-ELECTED?

7) THE OPPORTUNITY, NEGOTIATED BY THE MARSHALL TEAM, TO INSTALL MAJOR UCO FUNCTIONS IN THE CLUBHOUSE, AND IN COORDINATION WITH WPRF, TO PROVIDE “ONE STOP SHOPPING” FOR SUCH PRODUCTS AS PASSES, TICKETS, ID’s TRANSPONDERS, ALL ON COMMON COMPUTER NETWORKS; HAS BEEN SQUANDERED BY LOEWENSTEIN INCITED PERSONAL ANIMOSITY WITH WPRF; SHOULD HE BE RE-ELECTED?

8) LEGAL CONFLICT WITH WPRF, PRECLUDING FUNCTIONAL INTEGRATION OF KEY UCO TASKS IN THE CLUBHOUSE, NOW HAS LED TO THE POORLY PLANNED “NEED” TO CONSTRUCT A NEW UCO OFFICE BUILDING AT GREAT COST, SHOULD THIS TAJ MAHAL OF PERSONAL AGGRANDIZEMENT OF THE CURRENT ADMINISTRATION BE ALLOWED TO PROCEED? SHOULD WE ALLOW THIS TO GO ON BY RE-ELECTING THE GANG THAT CAN’T SHOOT STRAIGHT?

9) WHAT GAVE THIS CREW THE DIVINE RIGHT TO TURN OVER OUR PROPRIETARY FINANCIAL DATA TO THE INSURANCE INDUSTRY? WHAT GAVE THIS CREW, WHO’S FUNCTION, IS STRICTLY ADVISORY IN NATURE, THE IMPERIAL AUTHORITY TO DISPERSE INSPECTORS ONTO OUR ROOFS TO PRODUCE CONCOCTED FAILURE REPORTS? IN THE END WHAT WILL THIS ARROGATION OF POWER COST THIS VILLAGE? THE FOLLOWING RECITATION OF BAD JUDGEMENT SHOULD PROVE INSTRUCTIVE!

10) Failure: to uphold the oath of office of President of UCO.

11) Failure: to offer a limited apology to avoid the lawsuit by WPRF.

12) Failure: to offer an apology to a contractor that President Loewenstein personally denigrated, thus resulting in a $ 50,000.00 bill.

13) Failure: By, allowing the Nominating Committee to reject candidate applicants without any criteria, for the first time in the 24 year history of UCO.

14) Failure: to follow UCO by-laws, by requiring prior notice to attend Committee Meetings.

15) Failure: to provide an open forum for the WPRF/Operations Committee meetings, as required by the By-laws, this Committee operates in the dark and spends millions of dollars of our money, with virtually no constraints!

16) Failure: to allow open, uncensored discussions on the CV website/forum, a UCO sponsored function.

17) Failure: to maintain a properly updated reserve for the repaving of the Village. The fund has not been reappraised for 6 years!

18) Failure: by creating and encouraging the unnecessary animosity between Residents and WPRF.

19) SO! WHAT ARE THEIR STRONG POINTS? CONSTANT COMPLAINTS: “IT’S ALWAYS SOMEONE ELSE’S FAULT”; POOR JUDGEMENT; LACK OF CRITICAL THINKING; POOR PRIOR PLANNING IN ALL THINGS, ARROGATION OF POWER, EXCEEDING THEIR AUTHORITY; IN SHORT, A SOLID ABILITY TO SCREW UP ANYTHING THEY TOUCH! REALLY!! SHOULD WE GIVE THIS "KING MIDAS IN REVERSE" THE OPPORTUNITY TO SINK US DEEPER INTO THE QUAGMIRE OF EXPENSE AND ABJECT FAILURE? LINCOLN IS REPUTED TO HAVE SAID; “IF YOU WANT TO TEST A MAN’S CHARACTER; GIVE HIM POWER” WELL, LOEWENSTEIN & CO. HAVE BEEN GIVEN POWER AND THEIR CHARACTER HAS BEEN FOUND WANTING!!! SINCE THEY WILL NOT DO THE MORALLY CORRECT THING AND RESIGN, I SAY;

“THROW THE BUMS OUT”

Accomplishments of Bob Marshall's Administration

Several of you have asked that I try to recall some of the accomplishments of our administration. Keep in mind please that this covered the 2004 to2006 time period.

During the election process the item that seemed to be on many minds was the Millennium Agreement and whether or not it could be overturned, changed or just eliminated. We made several inquiries to legal firms including Rod Tennyson and Sacs and Sacs, who were the originators of the agreement.

We requested a formal inquiry and opinion from Gunster and Yoakley, an old and very respected firm of attorneys. These folks told us that while this agreement was not a very good one, we had lived with it for several years and trying to make any changes at that time would cost a prohibitive amount and probably not be successful. So we set out to make some accomplishments in other areas.

One of the largest accomplishments was the rapid recovery from the three hurricanes of those years. Yes, three hurricanes. I was not here for the previous 30 years but I understand that these were the first hurricanes to hit Century Village, WPB. So why if none for thirty years did we have to handle three in two years?!

Yes, I'm including the recovery efforts with the Clubhouse in these accomplishments. When all of the dust had settled it took one year to rebuild. The first permit was issued in May and it was reopened the following May. By far most of the reconstruction or the planning was accomplished during this administration. Oh yes, I do understand that the current administration tried to take all of the credit but you know what was done, when and who did it.
The local charities were extremely good to all of the residents but the coordinating took a lot of time and work. By the time the third one hit and we got it cleaned up, we were known as people who knew how to get things done and done right. In the office we found that the clerical staff had no Process and Procedure manuals to help them in their decision making process. Manuals were written for most of the activities. This gave the volunteers a place to research a question if they felt uncomfortable answering a question with their limited experience.

The UCO office was brought into the real computer age with computers networked. The one stop shopping concept was being developed as the Clubhouse recovery proceeded. This needs further discussion but I'll save that for a later submission.

The fire in the Wellington building is another example of how we worked for the unit owners. The roofing contractor had placed the tar heating apparatus on the roof, in violation of the law. When this heater caught fire it burned through the roof and the fire and resulting water damaged several apartments. I believe it was 10 or 12 apartments that were without electricity late in the afternoon. We held the contractors feet to the fire, brought an electrician to the site and restored the electricity to those apartments that permitted resident to return to their homes.

How does one choose?

In the National Election all of the candidates are calling for change.
We too can cause change by electing those running that had no part in the
current Administration’s decision to: disregard the Millennium Agreement and begin an illegal rent strike and proceed to court immediately. Incidentally, this is the basis for the court action by WPRF against Mr. Loewenstein, President of UCO. The cost for which, unfortunately of course, we are paying.

Accordingly, vote against the status quo by electing new talent wherever possible.

FREE SPEECH

George L might be right or wrong on the legal issues which are taking place as I write this post, I sure don't know. The one thing I do know is, UCO under his leadership refuses to allow the free flow of information on the CV Q&A FORUM. For this reason alone I cannot vote for George. Many an American died for this right that George has taken upon himself to deny The CV Membership.
We must elect someone who respects the basic American Right of unfettered speech in the next election.

United Civic Organization ELECTIONS

Here we are in another election season for Officers and Board Members for UCO.

Question:

Should we reelect officers and Board Members who ignored their responsibility to follow the mandate of the Millennium Agreement and:

1. Negotiate
2. Mediate
3. Arbitrate
4. Finally, file a law suit when the first three clearly fail to resolve the issues, and CLEARLY we have a real chance to improve the outcome with EVIDENCE supporting our position.

The Candidates seeking reelection clearly ignored this contractual mandate and began the legal action WITHOUT THE APPROVAL OF THE Delegate Assembly. Only a FEDERAL JUDGE finally put a stop their efforts.

Many believe we need someone to run against these officers who violated their responsibility and defeat their reelection bid, soundly.

Many others believe they should resign in disgrace, for their failures of judgment. Especially, since their actions have placed many hundreds of thousands of your dollars at risk in these legal actions.

How do you feel? I am sure that both the candidates and your neighbors want to know.
