A SAD EVENT BUT A HISTORICAL FIRST, WINDS OF CHANGE

In another Post, Ken Davis notes the unfortunate passing of Larry Kall, a sad announcement indeed and Larry will be deeply missed.

I cannot help but note in passing, that Post by Ken Davis is the first ever Post in this BLOG by an Officer of UCO.

It is a harbinger of change for the better.

I invite and strongly encourage all Officers of UCO, the LCAM, and Committee Chairs to scan this BLOG for important questions from the Unit Owners of CV and to answer them Authoritatively and Officially, I also extend this invitation to principles of W.P.R.F. Inc., on any query they may feel competent and predisposed to answer.

A query from one person may also be on the mind of many others; a question answered in UCO space is heard by only one person; use the power of 21st. century communications, not only can UCO answer questions here Officially, they can also quash rumors before they spread like wildfire, start unifying the Village, reach out and touch someone, quickly and accurately.

WHAT IS THAT ANTENNA AT THE FOUR CORNERS NEAR GOLF'S EDGE?

Hi All,
Have you seen this antenna at the corner of the Ring Road and Century Blvd., Did you wonder what it is?

Well it is a Telemetry (to measure from afar) monitoring station; it is part of the upgraded sewer lift pumping station being installed.

There are thousands of these SCADA (Supervisory Control and Data Acquisition) installations across Florida and Nationally.

They monitor the operation of many facilities and transmit data in real time to a central computer facility where

Engineers can anticipate incipient malfunction and within certain parameters effect repair, or dispatch a crew to fix the problem.

Check it out, it is not pretty, but it is important.

My neighbors say good things about the North County Senior Center (NCSS). They are picked up from their CV condos, the bus ride is free.

We are sorry to have to announce that our long time Associate
"Larry Kall" has passed away. He will be sorely missed by all of his friends and associates. Larry was the Comcast Cable Chair, the Transponder Chair and the President of Village Mutual. Larry's sense of humor when giving his reports were the highlights of Committee Reports at the Delegate Assembly.
Interment will be in Utica, NY
Memorial Services in Florida will be announced at a later date.

At the election meeting of delegates, it seemed to me that Larry mentioned at this point in the meetings with Comcast, one of the options would be that Comcast would make available channels 2 through 29 at the current rate.

He also mentioned a charge of $3.40 per month for a box for us to get the additional channels.

At least that was my understanding.

He wanted to get a feeling of how the residents felt about it and what way they want to go.

I don't know how many channels most users watch at one time but keeping things as they are now and with no need for a converter box to retain access to channels 2 through 29 seems like a no brainer to me.

If unit owners want additional or special channels then they should be the ones paying the additional fees for what they want. I don't believe it should be made part of the common element charges. Wonder how other delegates feel.

What Larry Kall (Cable Chair) was discussing is known as Basic Cable and this is the way Cable service has been defined for decades.

Basic cable, is a whole lot more than just the networks. I'll put it this way: think of every cable channel that no one would bother paying extra for. Well, most of those end up in your basic Cable package. Yes, that means channels like the Golf Channel and Lifetime (no offense if you like them!), but it also means another 15-20 random channels, at least a few of which will probably strike your fancy. Some folks will be able to get by quite happily with this set of channels. Yes, there's no cable news, and no ESPN (which hurts, but there's something fun about old-fashioned sports on the radio), but there's more than enough for someone attempting to watch TV in moderation.

The standard approach has always been as Jules describes; if you want additional services, you must obtain the Set-Top box and pay for the services you desire, that is how it is for millions of Comcast customers across the Nation.

To put it bluntly we have been spoiled by our generous channel package; but Comcast simply wants to put the Village on the same system as the rest of the Country, and I doubt we can talk them out of it.
I concur with Jules’ analysis of the situation as regards Cable service.

As an afterthought; we should explore services provided by the TELCOS such as FIOS, which in addition to hundreds of TV channels also provides High-Speed INTERNET up to 30Mbit.

FREEDOMS PRESERVED

THE FOLLOWING ARTICLE WAS REFUSED PUBLICATION IN THE "UCO REPORTER"

As I left the Delegate Assembly meeting on July 11, 2008 I met some friends who like myself were disgusted by what we just witnessed.

They suggested that in their and my own behalf I express in writing the utter frustration we felt sitting through the spectacle we as Delegates were compelled to experience.

More about that later.

The only topic discussed was the Sunshine Bylaw and the Administration's attempt to make it useless.
The Sunshine Bylaw was passed by an overwhelming majority of Delegates (116 for - 17 against) in the Delegate Assembly of July 02, 2004.

Early in 2007 I found it useful to remind the Administration of it's existance by publishing an article in the UCO Reporter of January 2007 which clearly cited the 2004 Bylaw in plain English no legalese doubletalk.

All was well until there appeared in the July 2008 UCO Reporter A definition of the Sunshine Bylaw which ran counter to what we passed in 2004.

I was happy to see that in July 11, 2008 Delegate Assembly meeting a vast majority again confirmed the Sunshine Bylaw leaving it virtually intact as an integral part of UCO's laws.

And now: a few observations about the meeting itself-

In my 17 years of active involvement in the affairs of UCO I have never experienced a more insulting way in which the chair addressed both the Delegates and UCO members at large who came to participate in UCO's business.

And what disgusted me more, was the fact that UCO's President did not find it appropriate or necessary to intervene when it became obvious that the way the chair handled his job was beyond acceptable limits of behavior.

Never before and I hope never again after this sorry spectacle shall we be subjected the that kind of rowdy insulting behavior from the top.

This is still the United States and not Zimbabwe.

Whoever is going to replace those among UCO's Officers who submitted their resignation when the vote overwhelmingly went against them will have to do better.

This morning I asked G. Loewenstein if UCO still had a political liaison. He explained that he and Phyllis have been our political contacts for the past couple of years. They stayed in touch with Aronberg and Buchner. George is meeting with Senator Lieberman tomorrow. George is also working with Aronberg to amend a recent condo law. G. says he has a good rapport with our politicians and they definitely listen to the village when he calls on them. If you want to know more ask George, mine was just a fly-by question.

So villagers can also remind the candidates this week “What have you done for us lately!” “What can you do?”

REMOVAL OF NEGATIVE POSTS FROM THE BLOG

Hi All,
An interesting Post in the BLOG calls for the removal of all negative (attack ) Posts. Thirty plus years in the Intelligence Community has given me a deep rooted respect for data gathering and the integrity of "The Record", modifying The Record presages a slippery slope that may raise some concern. The following quatrain occurs:

However, I fully understand the motivation for this request and the need to heal the divisions in our Village. THE OLIVE BRANCH OF PEACE

Traditionally the Olive Branch is offered as a token of peace and healing. I created this BLOG for the benefit of all our Unit Owners, so that they might be heard. I also read every word in the BLOG and while I appreciate the expressions of support, I am not deaf to the critical component published here.

What does this mean; it means that the bashing and criticism must stop. The talk about pulling out of UCO and Recall must not be pursued. UCO must not be destroyed, it must be Transformed, healed and fixed.

Of principle moment is that the Reborn President Loewenstein must be given the full opportunity to rebuild the fractured Village and the tarnished UCO, and we must all help him do so.

For me, this means that I must terminate my fractious and divisive postings and herewith I vow to do so.

I hear that the winds of change are already blowing in the tower of UCO and those winds bring good tidings.

I further offer myself as a cooperative volunteer in any function that President Loewenstein feels that I can contribute, hopefully in service to UCO and the Unit Owners of Century Village.

New Condo Laws

Homeowners who flew their American flags on the Fourth of July won't have to wait until Veterans Day to fly them again. A new state law says they can fly their flags every day of the year — even if their association rules say they can't.

Another new law says condo owners no longer have the right to put solar panels on the roofs of their low-rise buildings. Associations feared that without regulation, owners could damage the roof over everyone's head. Now, they can only put up a solar panel if it is solely "within the boundaries of a condominium unit.

"Five condo and homeowner association bills approved during the two-month legislative session that ended in May have been signed by Gov. Charlie Crist and became effective on Tuesday. Some are considered so confusing, however, that they may be changed next year.
Crist on May 1 signed a major condo reform bill that is effective Oct. 1.
It does several things, from letting owners display small religious objects, such as Jewish mezuzahs, on their doorposts despite association bans, to preventing owners who owe money to the association from running for the board.

Last week, Crist vetoed a homeowner association bill because it included a provision he said would have weakened state regulation of association swimming pools.

One of the five bills that Crist signed into law is considered especially confusing. It involves the rewrite of condo insurance law, and includes everything from the responsibility of unit owners after a hurricane to how a board must rebuild a building. The law appears to contradict itself and other laws.
Although they are on opposite sides of nearly every issue, attorney Gary Poliakoff and Cyber Citizens for Justice President Jan Bergemann agree about the confusion."I doubt that those who drafted the amendment, and those who voted for it, can explain the consequences of their actions," said Poliakoff, whose law firm represents 4,300 associations. Said Bergemann, whose organization seeks to protect owners from associations: "In this case I agree with [Poliakoff]. "The insurance law may accomplish something, however, said Yeline Goin, Fort Myers-based executive director of the Community Association Leadership Lobby, which represents boards in Florida. She said that after recent hurricanes, disputes arose between associations and owners over responsibility for payment. The new law, she said, establishes a "fairly easy-to-follow rule, which is: if you insure it, you are responsible for repairing it after a casualty, and also for any shortfalls that arise because of a deductible. "The law makes several other changes, such as giving a new name to the state agency that enforces condo law: the Division of Condominiums, Timeshares & Mobile Homes.

Here are other highlights:
• Foreclosures. SB 1986 says that a bank or holder of a foreclosed first mortgage may be liable to a homeowner association for up to 12 months of past due assessments or 1 percent of the original mortgage amount, whichever is less. This could help take the burden off owners who would be forced to make up for the foreclosed owner.
• Liens and receivers. Condo associations can't file a lien against an owner without giving the owner 30 days notice, a change that prevents associations from filing a lien the day after it says a payment is due (CS, HB 1105). Homeowner associations are already required to give owners 45 days to pay a debt before a lien can be filed for unpaid assessments.

Davie police arrested Winkelholz on Oct. 29 on charges of forgery and theft from the 264-unit Whitehall at Pine Island Ridge condo association, where he was president, and the 7,000-member Pine Island Ridge Country Club, where he was vice president.Trampani, 74, vice president of the Whitehall condo association, said he and dozens of his neighbors plan to ask to speak at the sentencing hearing. They want to persuade the judge to sentence Winkelholz to the maximum by describing the effects his crimes are having, especially on retirees living on fixed incomes.He said the stolen money amounts to about $3,000 for each unit in the condo association."People here worked all their lives and now, with the economy, don't know if they can pay for food and prescriptions," Trampani said. "They are coming in crying because they can't pay their maintenance. Don't you think they could use that $3,000?

Where is our Audit?

Here we are in August, and we have yet to see the Annual Audit for 2007 required by Florida Statutes and our Bylaws.

I mean a real detailed in depth Audit, by an arms length independent Auditor; not a friend of King George like Ms. Butner!!!

Following is an extract of Florida Statute 617, under which UCO is organized; it places on the Board of Directors (In our case that would be the Delegate Assembly) the responsibility of producing the Financial Report for Unit Owners “within 60 days following the end of the fiscal year”

How is that possible since UCO has thus far failed to produce this years audit.

Of course you may remember that Treasurer Tetro has repeatedly stated that she only knows what lines to put the numbers on.

We must see the Books; it is our money, what is being covered up???

The report shall show the amounts of receipts by accounts and receipt classifications and shall show the amounts of expenses by accounts and expense classifications.

Following is an extract of our Bylaws of UCO, requiring an annual Audit, which has yet to be produced

C. TREASURER —

The Treasurer shall keep a full and correct account of all cash receipts and disbursements and deposit all funds in banks, or financial institutions, in the name of and to the credit of the organization.

All such deposits must be secured by the United States government, or in bank CDs. However, said deposits of funds may be invested by loans to WPRF or its successors for "Operating Expenses" and/or the "Operational Budget" under the Millennium UCO Amendment to Long Term Lease.

Said loans are to be repaid as decided upon in each case by the Operations Committee. He shall disburse the funds, as need may arise, accepting proper invoices or vouchers for such disbursements.

Checks issued in behalf of UCO must be signed by the Treasurer and the President may substitute for either.
A check will not be issued which does not carry two (2) signatures. He shall be Chairman of the Finance Committee and shall, with the assistance of that committee, prepare an annual budget for approval by the Officers, the Executive Board, and the Delegate Assembly in October.

He shall arrange for an annual audit of the books and records of the organization by a public accountant certified by the State of Florida.

Out of the west comes the Lone Ranger – who wore a mask to hide his identity. Why? To defeat the bad guys! On the other hand we compare this to the Phantom of the Opera or stage coach and bank robbers that wear masks to hide their identities. What a wonderful tool the blog is. These people are the John Doe’s or Jane Doe’s of Century Village. Make statements that are bereft of fact on issues they have very limited knowledge about – yet they posture themselves as having their finger on the pulse of things. It’s a shame that these “observers” of CV don’t have the courage of their convictions and tell us who they are. how they know what they cliam to know. How any decent person could maintain any sense of credibility if they don’t have the “guts” to put their name where their mouth is should be given an award. I will call it the "CERTIFICATE OF RESPERATION "–it is granted to those anonymous “phantoms of the blog” for his/ her ability to breath!

Now that the election is over and things appear to be calming down, I wish to thank you first for the creation of this blog that has allowed everyone to express the good, the bad and the ugly, but most of all I would like to thank you for your decision to run for president of UCO. As far as I am concerned, it was a chance for this village to go in the direction of legal, mutual respect and harmony----an opportunity for it to truly be a great place to live. You gave hope to many people . By your posting in the election cycle, people became better informed than ever before. That in itself is a great achievement; it never would have happened had you not announced your candidacy. The time for peace and harmony through legality is yet to come. Those of us who value respect and legalities will have to struggle a little longer.

We got to meet the bitter anonymous (most probable) at the rally, too bad Dave has a neighbor like that. A pity she does not grasp that the best people become angry when they see lies, cheating, repression, and the elderly taken advantage of. (WWJD)

An open letter to the Officers of UCO

The election results are in and Mr. Loewenstein who resigned 7-11-08 was reelected.

However the margin of victory was not the mandate he took the March results to mean.

The 104 votes for Mr. Loewenstein are a scant 17-vote plurality over second place and only a mere 42 % of the votes cast. Even smaller if you count the entire 349 eligible to vote, it is only 32 % of that total.

I would presume this means this community now wants a healing of the partisan and denigrating approach that has been the pattern of the past. Any effort to include people that want to help this Village should be considered and like David Bernstein, former UCO VP, said, forget what happened in the past, and look forward to see what can be done for the future.

Mr. President, the ball is in your court to resolve the bitterness, I for the sake of this Village, encourage you to make that your first order of business. This Village is ready for all our efforts to band together for the common good! Many of us know you are regularly informed on comments on this blog and surely only you can now change the direction of this Village by INCLUDING EVERYONE THAT OFFERS HELP. We can all agree that a movement for 141 Associations to pull out of UCO would not be good for this Village nor would a recall. Please consider the future of UCO seriously.

As you may not be aware, King George Chaired the Operations Committee meeting yesterday (Friday, August 1, 2008).

This assumption of power, done without the formality of being sworn in, may appear to some a mere oversight.

Not so, this is far more than a matter of Form VS Substance; it is indicative of the arrogance and disrespect for law that is the hallmark of King George's reign.

It presages an era of no change and a return to "business as usual" in UCO land.

Think about it. This time, we could remedy all of the mistakes in structure, we are now stuck with.

As for the religion issue, it was evident in this election and was a major factor when the Marshall group was defeated. God help the village if those of you who voiced your need for change do not stay united and on target for continuing to work for change.

And to those who still want to bash me, there is nothing left that you can accuse me of or say about me that you haven't already. You wouldn't attact me if you were not afraid of me because I stand up for what I believe and I put my money where my mouth is.

No matter what you say or do to me I will always be here to watch you and fight your closed meetings, hidden finances, undemocratic closed media and all of the other attrocities you try to perpetrate on this village.

You have literally enabled the lunatics to take over the asylum. How after witnessing the shameful debacle of July 11th. 2008 could you grant any credibility to this petulant child, who, when reversed by his Board of Directors, quit in childish snit!

Where is the leadership, where is the morality and ethics? Situational at best outright toxic at worst.

As I left the Theater after Delegate Assembly, I encountered Howie Silver; he immediately acted out his genetic code instructions and flashed me a vigorous "short arm salute", charming, Howie, simply charming"

Where will King George get the credibility to run UCO? His 104 votes are hardly a mandate, so I say to those of you who cherish the freedoms we hold so dear in America; attend every meeting, insist on your rights as Unit Owners, if enough disinfecting sunshine engulfs King George, perhaps he can be induced to do the right thing again; resign; or emulate the movie vampires and simply vaporise in a puff of fire and smoke!!!

For the moment; I suggest that those of us who still retain our sanity and reason seriously consider a movement to recall King George before we are once again sucked back into the Dark Ages.

Hi All,
Following is a letter of support written by five Unit Owners. You will note that among other things, I have called for the integration of Professional, Subject expert, staff in the running of the 5 million dollar BUSINESS that is UCO. As an example, I gave Financial operations and Investigative services.

In neither case would this lead to the firing or removal of any paid employee or volunteer. For example, let's look at Investigative Services; If we hired a paid subject expert to sit in UCO spaces who would conduct Credit and Criminal Background checks using a computer in UCO and paid him/her $40,000.00 /year; we would save some $110,000.00/year.

How could this be, you may ask? Simple; at $100.00/investigation, multiplied by 1500 investgations per year, we are now spending some $150,000.00/year of Unit Owner money.

Clearly, the difference is no small matter. A trained professional could reach into places that we currently do not access and do a much better job than our current Investigative firm. The hard working volunteers jobs of dealing with the Associations would not change one iota.

The Professional Subject Agent would simply feed our volunteers the work product "up close and personal", taylored to our needs.

Ignore the rediculous rumors, UCO is a BUSINESS, and must be run as such, paid and volunteer positions are safe, if I am elected:

A Good Man for the Job at a Needed Time

There are a number of us who believe Dave Israel is the right man for the job of UCO president at this time. We would appreciate your reading this letter.

The Village has come through some difficult times over the past four years, and we are not out of these difficult times. Florida's hurricanes, including the three that hit us in a two-year period, have had a lasting, widespread effect.

Insurance rates have gone way up, and insurance is being required where it was optional before.

Building code requirements are stricter and thus more costly, also. Running the Village at both the local association level and the overall (UCO) level gets more and more expensive.

There is a critical need for

(1) accountability to all owners and associations through their delegates and the media,

(2) clear explanations about complicated matters, and

(3) honest, wise, caring, and capable people in the top positions.

Transparency is a vital ingredient. Dave Israel took a step in this direction when he instituted the Internet blog, open to anyone's comments.

Those who pressed for truly open meetings at the July 11 delegates meeting took another vital step in this direction.

Yes, there can be some problems to be overcome in having meetings be "open," but they should not be compared to the alternative—having important, costly matters discussed and decided upon behind closed doors by a select few.

Closed-door meetings shut out the possibility of wise counsel, including perhaps good cost-saving suggestions, coming from outside the select group. Closed-door meetings at their worst are an encouragement to shady dealings taking place.

Dave is a leading proponent of open meetings.

It is not a good indicator to us when the UCO president and a vice president resign after the delegates overwhelmingly vote for enforcement of strictly open meetings—especially as open meetings have already supposedly been our policy in having adopted the Sunshine Laws a few years ago.

It is even less a good indicator—in fact, quite frankly, one's suspicions cannot help being aroused—when within a few days of resigning, the same president and vice president do a complete turnabout and place themselves in the running for the same offices they vacated.

What else is Dave Israel for?

He is for hiring professional people in two areas: financial and investigations. We do not mean to criticize those volunteers who have worked in these departments. Many have put in long hours and much effort. But we agree with Dave that in a multi-million dollar operation, we need top-quality expertise to save money in our financial operations.

And we need professional expertise in the investigations department at a time when litigation abounds and an association could be sued for turning down a prospective owner or renter.

Do we even have the reserve funds now that we should have in order to pay for such litigation? We don't know, because the present administration closes off so much to any inspection.

• Dave has a great deal of experience in running important things. Please take a look at his bio. The United States government has entrusted him with a lot. He wants to gather people around him who can help make the difficult decisions that have to be made and save us from disastrous financial mistakes.

Dave also wants to inform every resident in as clear a manner as possible concerning complicated matters. He would use the UCO Reporter to this end, changing it from being opinion piece after opinion piece to largely unbiased reporting of the news.

How can this be accomplished? The news can probably never be presented in a completely unbiased manner, but the effort should be made. Newspapers, as we all know, have their news separate from commentary.

Dave realizes that to accomplish this as UCO president, his own administration must be especially scrupulous to avoid pushing only "their" way of seeing things. We believe Dave will make that honest effort.

If you have read this letter through, we thank you indeed. We hope that those of you who are delegates will vote for Dave Israel for president of UCO. Above all, we respect your participation in the democratic process.

A new Beginning on Channel 63

Please notice the beginning of change resulting from the July 11, 2008 Delegate Assembly meeting.

Channel 63 now contains more meeting notices because our corresponding Secretary Avis Blank has complied with the intent of open meetings and published a list of those meetings.

Notices were posted on all Association Bulletin Boards at the direction of the two remaining Vice-Presidents Bummolo and Cornish with candidates Biographies.

Executive Board Member and Security Chair Al Mclaughlin has made the security meeting agenda available to comply and it too is now on Channel 63.

The delegates should realize the beginning of change is in the air, and compliance has begun in part THANKS to those named above!

After many years living at Century Village and having served the residents as an instructor for over a decade, illness forced me to cut down on activities.

Last year, because the president of my association refused to go to delegate meetings, I insisted he appoint me (a board member) as delegate of our building.

Since attending the meetings I have discovered why he refused to go to meetings and why our building does not follow the UCO recommended by-laws.

The meetings are held without regard for unit owners wishes and/or desires.

There is a wall of egomania that pervades the meeting with constant dissent and childish rhetoric blasting the atmosphere.

Recently the president and vice-president of UCO resigned stating that they felt the assembly was not supporting them.

Yet at the recent delegates meeting these same people are once again running for their same office. I don't know if that is permissible or not, but it is certainly immoral if ethical.

If you are not wanted, by your own admission, why try to force yourself on the unit owners? Does it make you a better person or more useful to be where you will be less effective in doing your volunteer job?

I may be naive or ill-informed, but I feel the unit owners are not being served by this kind of administration.

How About a Debate?

Since we have a number of candidates for offices, how about having a debate among those running for the same office?

For president: Israel, Loewenstein, Richland.

For vice president: Davis, Karpf, LaBonte, Marshall, Silver, Ziccardy.

This would give us all a better insight as to who we personally would support.

This would draw a large group of CVers to help make their decisions.

On another note, just to keep a little levity in this situation: CV seems to have a dog problem. How about a few people running for dogcatcher? Just think: The dog problem could be handled by a committee. Decisions could be made as to where a dog could relieve itself, get a drink of water or under what conditions it would be permissable for the dog to bite someone. I think we all would like a debate among those of us who would like to run for the office of CV Dog Committee Chair. Keep thinking, it helps to avoid senior moments.
